IF YOUR LOVED ONE DIED WITH A WILL OR WITHOUT AN EFFECTIVE ESTATE PLAN IN PLACE

If your spouse or loved one has passed away leaving being a Last Will and Testament, you will have to go through the Probate process. Probate is the process of filing the Will with the Court and having the person nominated as Personal Representative/Executor appointed by the Court.  It can be an extremely complicated and length process and the Personal Representative will be personally liable if they do something wrong.  As a result, it is important to get the assistance of an experienced attorney when handling the Probate of a Will

If your loved one had a Will, the family will go through a process called Probate. Probate can be extremely complicated and you can be personally liable if you do something wrong, therefore, it is important to get the assistance of an experienced attorney when handling the Probate of an Estate.  

If your loved one died without a Will and without a Trust, and there are assets solely in the deceased person's name, you will also have to go through Probate.  It is a similar filing process as if they had died with a Will, however the only difference is the court will determine to whom the assets will pass to by following the state law.

Probate includes:
Filing a Petition and all necessary paperwork with the Probate Court
Notifying all beneficiaries and heirs
Publishing in newspaper if required
Doing Inventory and Accounting of Assets
Paying any debts, claims, taxes, expenses of the decedent
Distributing to the heirs or beneficiaries of the decedent
Closing out the Estate

 

STEPS TO TAKE WITH A LIVING TRUST

If your loved one died leaving behind a Living Trust you are able to avoid Probate. Instead your family will go through a process called Trust Administration which includes notifying all beneficiaries and heirs of the decedent, collecting all property such as real estate and bank accounts, paying debts, taxes, claims, expenses, and distributing according to the terms of the Trust.
